1. Any person, organization, genetics advice centre, genetics laboratory or genetics clinic, including such clinic, laboratory or centre, including ultrasound machines, imaging machines or scanners or any other technology capable of conceiving and sex selection of the foetus, facilities for prenatal sex determination or pre-pregnancy sex selection, which such centres, laboratories, The Clinic or any other place shall not issue, publish, distribute or communicate any advertisement or cause to be continued, published, distributed or communicated in any form including the Internet.

2. Any person or organization, including a genetics counselling centre, genetics laboratory or genetics clinic; not issue, publish, distribute or cause to be issued, published, distributed or communicated by any means, whether scientific or otherwise, any advertisement in any manner relating to prenatal determination of sex or pre-pregnancy selection.

3. Any person who contravenes the provisions of sub-section (1) or sub-section (2) shall be punishable with imprisonment for a term which may extend to three years and with fine which may extend to ten thousand rupees.

Explanation: For the purposes of this section, advertisement shall include any notice, circular label, cover or any other document, including advertisement in electronic or printed form through the Internet or any other media and shall include board advertisements, wall-painting including any visualization made by means of painting, signs, light, sound, smoke or gas.
