Question- What is Sexual Harassment Act 2013?
Answer -
The Sexual Harassment of Women at Workplace Act 2013 recognizes this and other forms of sexual harassment and says that any behaviour shall be deemed to be sexual harassment at workplace when it occurs under the following circumstances :
➤ Promise of discriminatory treatment, directly or indirectly, in the employment of women.
➤ Threatening directly or indirectly to harm the employment of women.
➤ Threats, directly or indirectly, about the present or future employment of the woman.
➤ Interfering with work or creating abusive, objectionable working conditions.
➤ Abusive treatment that endangers the health and safety of the woman.
What is workplace?
There has been much debate as to what would be the definition of the workplace in the context of sexual harassment. It has been argued in the past that the workplace is limited only to the premises where the employees sit and work. Some others also say that the workplace also includes all the public places where an employee goes in connection with his job.
It is now accepted that the workplace is any place where there is a working relationship between the employer and the employee, which may be outside the boundaries of the office premises.
Expanding its definition further in the Sexual Harassment of Women at Workplace Act 2013, it has been included in all places including transport where a person goes in connection with his employment, which includes :

Any department of the public sector, organization, institution, establishment, office, branch or unit which directly or indirectly takes financial help from government or local authority, government company, corporation or co-operative institution, or is established or controlled by them.

Any private sector organization or private enterprise institution trust, NGO, service provider, engaged in business, business, educational, entertainment, industrial, health related or financial activities including production, supply, sale, distribution and services.

Any hospital or nursing home.

Any sports institute, stadium, sports venue, place of residence also if it is used for sports training or other work.

Any place where an employee goes in connection with his work, such as traffic provided by the employer for the work.

Home or place of residence.

Unorganized sector workplace.
